Datuk SM Faisal SM Nasimuddin Kamal has filed a lawsuit against rapper Caprice, accusing him of uploading defamatory posts on Instagram linking the businessman's case with his ex-wife Emilia Hanafi.
On August 15, SM Faisal, 43, filed a complaint with the Sessions Court through Messrs Akberdin & Co, naming Caprice, whose real name is Ariz Ramli, 36, as the defendant.

SM Faisal claimed that on June 27 in the statement of claim that the Syariah High Court of Kuala Lumpur had ordered a seven-day sentence after Emilia was found to have failed to comply with the court's commitment order.
He claims that Emilia or certain parties with malicious intent publicized and manipulated the incident through the mass or electronic media without any reference or clarification of the true position of the plaintiff or the Syariah Court in the case involving the plaintiff and his ex-wife in the Shariah Court.
SM Faisal claimed that on the following day (June 28), the defendant (Caprice) defamed the plaintiff or the Syariah Court by uploading a defamatory post on Instagram.
“The defamatory post was widely publicized because the defendant had approximately 1.5 million followers on Instagram and the post was viewed or liked by approximately 14,500 people,” the plaintiffs allege.
SM Faisal claimed that the defamatory message meant, among other things, that he was a cruel and reckless person who, in addition to being inconsiderate and aggressive towards women or children which include wanted to imprison his ex-wife.
The plaintiff stated that in addition to being ridiculed by the public, the defendant's behaviour also caused him emotional distress.
The businessman alleges that on July 7, a request was sent to the defendant to take down the post and tender an apology to the plaintiff, but the defendant did not comply.
In addition to requesting orders to remove defamatory posts, defendants are also required to prevent defendants or their representatives from harassing and threatening plaintiffs and their families, either verbally or through social media.
Plaintiff seeks general damages, punitive damages, exemplary damages, aggravated damages and costs.
Speaking to reporters today, SM Faisal's lawyer Datuk Akberdin Abdul Kader confirmed the filing of the defamation suit, adding that case management by Sessions Court Judge Idah Ismail will take place on October 14.
